Dont Allow Yourself To Fall Into A Cycle Of Depression
First, its perfectly normal to feel confused and depressed after you fail out of nursing school. Youll probably feel like a dumb person. Youll see that other people passed, and youll feel embarrassed by that. You may even begin to feel as if your life is pointless or that you have nothing to offer the world, and you wont know what direction to take next.
Thats how everyone feels after experiencing a major setback.
Take some time to vent about it. Cry about it. Pray about it. Eat some junk food, and feel sorry for yourself a little bit. Youre human, and you need to have a period of grief. But dont stay in that rut, and dont allow yourself to engage in destructive behaviors, either.
Have your down moment, but then you need to pick yourself back up again. You have a purpose in this life, and you have gifts and talents to offer this world. You are going to make a huge difference in this world, so dont let this setback stop you from accomplishing great things.
Some of the most successful people experienced devastating failures in life, but they didnt give up, and neither should you. Many other nurses have been where you are, but they kept pushing.
Take Advantage Of Resources
The student who submitted the question asked where she could obtain more information about her rights when dismissed from a program.
The first resource for anyone in this situation would be a nurse attorney or attorney who concentrates his or her practice in education law and who represents students.
Obtaining a consultation as quickly as possible will help determine how to proceed in challenging the dismissal and obtaining legal representation in the dismissal proceedings.
Because the student who submitted her question is in an initial nursing education program, she also could use her membership in the National Student Nurses Association.
Along with its many benefits, the association advocates for the rights of nursing students and has several publications that may be helpful, including the Bill of Rights and Responsibilities of Students of Nursing.
Nursing education programs have an obligation to ensure students enrolled in their programs fulfill all requirements of the program, including grade point averages, clinical competencies and adherence to its established student code of conduct.
The programs also have an obligation to adhere to the protections afforded students and to be fair, reasoned and principled when considering a dismissal of a student in its program.

What Are The Potential Sanctions For An Academic Misconduct Violation
Depending on the infraction, sanctions may include: academic probation a reduced grade loss of course credit loss of scholarships or financial aid loss of student housing suspension or expulsion.
The college may note the penalty on your permanent record, which may prevent you from gaining admission to other university or graduate programs. The penalty can even result in a current employer firing you or your being automatically disqualified from some jobs.

D Plaintiff’s Request For Leave To Amend Will Be Denied
At the end of her Response to Defendant’s Motion to Dismiss, Plaintiff requests leave to amend by stating:
Should the Court grant any portion of the Defendant’s Motion to Dismiss, Plaintiff requests leave to amend her complaint. Leave to amend “shall be freely given when justice so requires.” F.R.C.P. 15. Leave to amend should not be denied without reason, such as undue delay, bad faith or dilatory motive on the part of the movant. Forman v. Davis,371 U.S. 178, 182 . Plaintiff has not previously amended her complaint and granting Plaintiff leave to amend would not unduly delay the case.
Matter of Southmark Corp.,cert. denied,Id.inter alia,Id.
Plaintiffs’ Response, Docket Entry No. 29, p. 9.
Plaintiff has already amended her complaint once. Because Plaintiff has already had an opportunity to file an amended complaint, because Plaintiff filed a detailed response to Defendant’s Motion to Dismiss in which she argued that her Amended Complaint was sufficient to withstand Defendant’s Motion to Dismiss, and because Plaintiff has failed either to submit a proposed second amended complaint or to describe additional facts that could be alleged in such a complaint, the court concludes that the Plaintiff has pled her best case, and that allowing Plaintiff the opportunity to file another pleading would do nothing but prolong the inevitable. Accordingly, Plaintiff’s request for leave to amend will be denied.
What Should I Do If I’m Notified Of An Academic Misconduct Violation Against Me
If your school accuses you of academic misconduct, take these four steps:
Stay calm. Do not panic or fire back a rapid response to the university, even to defend yourself. Do not admit to anything, or try to explain the circumstances to anyone other than a parent or your attorney.
Review the school’s code of conduct. Try to understand the allegations against you, in light of your school’s code of conduct. If there seems to be a disconnect between the charge and school policy, write down any questions you may have.
Write down the events. Start recollecting and recording all details relating to the alleged incident. Include the date, time, potential witnesses, text messages, photographs, and any other facts or details you believe may be relevant.
Contact an academic misconduct violation lawyer. An attorney experienced in handling academic misconduct violation cases can help assess the seriousness of the allegation, collect vital evidence, prepare a strong defense. The earlier you hire an experienced lawyer, the better chance you have of obtaining a favorable outcome.

Private Education Program Rights
If, in contrast, you are a student in a private nursing education program, your rights consist of what the academic institution provides you with. As a result, student rights in private programs vary considerably and are spelled out in the student handbook.
Whatever protections surrounding dismissal from the program are granted by the institution must be adhered to. The student handbook becomes the touchstone of how the nursing program handles a dismissal.
If the dismissal is not consistent with the student handbook and past dismissal decisions, it can be seen as arbitrary, capricious or discriminatory. As a result, it would not be upheld if you were to challenge the dismissal in court.
The protections accorded by both a public and private post-secondary nursing program apply to you as a student in all nursing education programs at whatever level.

Public Education Program Rights
If you are in a public college or university, your rights are dictated by the U.S. Constitution and case law interpreting your rights under the Constitution. Because you dont leave the Constitutions protections at the entryway of your academic campus, your rights follow you throughout the program.
Insofar as dismissal from a program is concerned, the nursing programs student handbook spells out your rights vis-à-vis the Constitution. They include:
Notice of the reason for the dismissal.
The right to a hearing before the dismissal occurs.
Notice of the time and place of the dismissal hearing.
The right to present witnesses in your favor.
The right to a written decision by the academic program.
In most instances, the right to legal representation at the hearing.
These rights are called due process rights. Because the law sees graduating from an educational program as a property right , certain protections must be provided to the student to ensure a dismissal is not arbitrary, capricious or discriminatory.
You might wonder what the terms arbitrary, capricious or discriminatory mean.
An example of an arbitrary decision would be if it were illogical, subjective or made by chance. If you were dismissed without a solid, objective or valid reason, and you could prove this, the dismissal would not be upheld by a court.
